Thank you for choosing Villa Escondida San Miguel de Allende for your stay! To prevent misunderstanding of expectations the following terms and conditions apply. Contact us should you require clarification.

The terms and conditions of booking your stay with Villa Escondida are presented below. Villa Escondida San Miguel de Allende (Villa Escondida SMA) is owned by Colibri Property Investments Limited. The company is registered in the United Kingdom under registration number 13355671 in Luton, Bedforshire, in the United Kingdom. Customers renting the property VIilla Escondida SMA are referred to as the “Guests” or the “Guest” and the owners of the property are referred to as the “Owners” or the “Owner”.

BOOKING

All bookings can be placed either through the secure website (villaescondidasma.com), by phone +44 (0)794 026 9677, WhatsApp +52 (55)2717 1810, or email (contact@villaescondidasma.com). Availability seen at the time of sending the email by the guest cannot be guaranteed as an alternative booking may be taking place in the meantime.

The guest placing the booking must be over 21 years of age on the check-in date. No reservations and therefore your desired dates will be fully confirmed until the information and ID's for all guests on attendance have been provided and verified by Villa Escondida's management. Be sure to send all the documentation as soon as you possibly can after you request your booking with Villa Escondida. We will need to receive responses to any questions sent to you and the full names, valid email addresses, telephone numbers, valid Government ID's (preferably a valid passport or driver license) for all adult guests included on the reservation.

These terms and conditions outline the rules and regulations for the use of Villa Escondida SMA's Website, located at https://blackmore-doqa0rzjxncjjgp8.builder-preview.com.

By booking with us, it is understood that you have accepted these terms and conditions. Please do not proceed with your booking with Villa Escondida if you do not agree with all of or any of the terms and conditions stated on this page.

CANCELLATION POLICY.

  • Cancellations 30 days prior to arrival will receive a refund of monies paid, minus a 10% booking fee.

  • Cancellations less than 30 days prior to arrival, late arrival, or early departure receive no refund partial or in full.

  • NO SHOWS. No shows will be considered "cancelled by guest" and no refund will be issued.

REFUND POLICY.

  • If an event was to occur (EXCLUDES FORCE MAJEURE) directly with the owners and/or the property that will keep the owners from honouring a guests' reservation, the owner/house manager will notify the guest as soon as possible of the situation and if at all possible will work with you or direct you to a trusted agent to find suitable accommodation for your trip. If such unlikely event was to occur the owner/management at Villa Escondida will provide a full refund to guests.

  • If a guest cancels the reservation at any time outside of the terms of the Cancellation Policy, the terms of the Cancellation Policy will apply and no refund will be issued.

  • FORCE MAJEURE. We strive to make your stay from the time of booking a pleasant process, and though we understand things can happen to everyone, cancellations outside of the Cancellation Policy window will affect our business. We do not offer refunds for natural disasters or other major events personal or otherwise that are out of our control. We strongly recommend you purchase trip insurance that includes a clause along the lines of "Cancel For Any Reason" so your insurance can cover your refund in case of a natural disaster or any other major events. Please notice we do not sell trip insurance.

HOUSE TERMS AND CONDITIONS.

1. Firstly and most importantly, prior to booking, all guests must read all house terms/rules and be willing and able to respect them during their stay. In the event of a breach of these terms and conditions at any time of the stay, the Guest will be required to leave the property immediately and no refunds will be offered.

2. CHECK-IN (between 2:00 and 10:00 pm) and CHECK-OUT (on or before 12:00 noon) are important. Changes/delays to guests’ schedule and therefore time of arrival must be notified immediately. A member of our team will open the door for guests, introduce them to the house and give them the keys to the property

  • 2a. Rental Period. Your stay commences at 2:00 PM on the day or arrival and ends at 12:00 noon on the day of departure, unless different check-in and check-out times have been previously agreed on by the "Owners" and "Guests", delays to vacate the house up to 60 minutes will incur a $500.00 MXN or $75.00 USD late check out fee. Delays over 60 minutes will incur a full day rental penalty fee without the right to remain in the property.

  • 2b. Depending on availability we may be able to accommodate a slight early check-in or slight late check-out. For this, kindly check with us about availability several days in advance. Only if it does not interfere with any other bookings (arrival or departure of other guests) it will be our pleasure to arrange this for you.

  • 2c. Two sets of keys will be provided. Please know the keys to the safety door locks at the main gate and door are very expensive to replace. Only selected locksmiths offer this service. It will take about a day to have any lost keys replaced. There will be a charge of $125 USD per set of keys to be replaced.

3. VILLA ESCONDIDA SMA allows living on three separate levels including our stunning roof top terrace with amazing views of the city. This is the result of the house being elevated and with a somewhat steep final approach to the house. The above could be a potential downside for some individuals, because to fully enjoy the property and its amenities there are a series of stairs that could be challenging for those with restricted mobility and possibly not suitable for small children. Please keep in mind that the property is not handicapped accessible. Accepting this clause indicates this does not represent an issue to ANY of the guests attending.

  • 3a. CHILDREN. We will not be held responsible/liable for any issues caused by children on the premises. For example, but not limited to, running up and down the stairs, climbing walls/safety fences, jumping on beds or couches, etc., that could cause harm to any child and/or damage to the property. It is the sole responsibility of their parents or accompanying adults to keep children from causing damages and remain safe. Damages to the house and/or its contents will be assessed and deducted from the guest’s security deposit at the owner’s discretion.

4. MAINTENANCE. Cleaning and Gardening are essential to the optimal upkeep of the property, and these require time. Staff must attend these duties several times per week, so guests enjoy clean indoor and outdoor spaces during their stay. The cleaning and gardening staff have a set routine and are not allowed to deviate from any of their tasks/duties to comply with extraordinary guest requests not included in their routine.

  • 4a. For stays a week long or over, up to 8 hours of cleaning are provided during your stay at no cost to you. Should you require more time of cleaning services there will be a cost of USD$15.00/MXN$300 per hour and USD$20.00/MXN$400 per hour if guests require staff to cook for them. These services must be confirmed, and paid for in advance.

  • 4b. To not disturb our guests during the morning hours, gardening and cleaning tasks take place on weekdays after noon time between the hours 12:00 noon to 6:00 pm.

  • 4c. We pride ourselves in the professional and respectful ways of our house staff and management. We reserve the right to remove any guest that display rude and/or disrespectful behaviour to staff and neighbours without refund.

  • 4d. We ask guests to kindly leave the house in good order and in a state that will not result in inordinate cleaning upon their departure. A charge of MXN 1000.00 Pesos per hour OR 60.00 USD per additional hour of cleaning will be assessed and deducted from the guest’s security deposit if the property is left in an unreasonable and unfit state. Guests' kind cooperation is requested in this regard and appreciated in advance.

5. HOUSE MANUAL. A house manual will be available in hard copy with step-by-step instructions on how to operate appliances/devices. Guest’s will not attempt to “fix” any issues with any devices by themselves. They must notify the team immediately to trouble-shoot. Any damages caused due to failure to comply will result in deductions from the Security Deposit.

6. OCCUPANCY LIMITS. There is a strict limit of 6 people registered as guests during any stay at Villa Escondida (including children). The house manager or his/her assistant will receive the guests in person and introduce them to the house.

  • 6a. Each guest must be listed in the registration with their full name, a valid Government ID, email address and a valid/verified phone number for each adult guest. These must be sent to the host to have the booking approved. In the unlikely event of an emergency, we must be able to contact each adult by phone. To comply with health and safety regulations with the local government, we cannot make any exceptions.

  • 6b. No third-party bookings will be accepted. Only people who booked and are listed/registered will be allowed to remain at the property. Entry may be refused to all/any people that are not registered. The valid/verified government IDs previously sent are to be presented on arrival.

  • 6c. Any undeclared temporary guests that may come to visit must depart the property by no later than 11:00 pm. Failure to do so may incur an additional fee of up to 100% the daily rate per person at the discretion of the owner. Registered guests understand they are financially liable/responsible for any damages/loses caused by other individuals they bring into the property.

  • 6d. Subletting stays at Villa Escondida in any form Is Not Permitted. Breaking this rule will result in the removal of all guests from the property immediately without refund.

7. SMOKING / VAPING / ILLEGAL SUBSTANCES / ACTIVITY / WEAPONS. Smoking, vaping, or the use of any drugs is absolutely not allowed on the premises. Smoking is a safety hazard as it could lead to a house fire. Cigarette smoke smell is extremely difficult and very expensive to remove from furniture, upholstery/linens, etc. Failure to comply with this rule will incur a daily $3,500 MXN OR $200 USD penalty fee to be charged for each day of the guest stay plus the cost of replacing any items damaged by smoke and/or cigarettes such as but not limited to burned linens, upholstery, furniture, etc. Illegal Substances/Drugs and weapons of any kind are illegal and will lead to legal consequences for some or all the guests in the house. Local authorities take these matters very seriously.

8. NO PETS ALLOWED. Family members have serious allergies to pet dander and all cats. We appreciate your understanding.

9. PARTIES / EVENTS. Loud and crowded parties or events are not allowed on the premises. The community has zero tolerance for loud noise and unruly behaviour (Reasonable noise levels up to 10:00 pm is generally accepted.) There is an active and vigilant 24/7 neighbourhood watch program, and neighbours will report noise violations and potentially dangerous, violent, or illegal behaviour to the authorities. Failure to comply may result in guests’ immediate removal from the property with no partial or full refund for the remaining days of their stay. Any damages will be assessed and charged accordingly including any monetary penalties imposed by the authorities.

10. CONSEQUENTIAL DAMAGES. Financial penalties will be incurred by guests if any damages keep the next guests from obtaining use of the property or the property is unfit for rental after their stay. These will be at least but not limited to the daily accommodation expenses to the upcoming guests that were affected by damages they caused. And/or monies lost by the owner for not being able to rent the property.

11. FERAL ANIMALS. Wild animals are not to be encouraged onto the property. We ask guests Not to Feed any animals on or near the property, including but not limited to cats, squirrels, birds in particular pigeons as these are extremely hard to eradicate. Guests need to remove all leftover food from outdoor spaces by placing in garbage or compost containers as guests vacate balconies and/or terraces.

12. MINOR UNEXPECTED ISSUES. We understand that accidents happen on occasion and things could break, spill, etc. We ask guests to kindly…

  • 12.1. Clean spills as they happen to minimize the risk of permanent staining.

  • 12.2. Let us know promptly if anything brakes, leaks, if there are spills or stains so we can direct our team to remediate the situation for guests during their stay and to ensure the property remains in good condition for the rest of their stay and can be made available for the next guests also in good condition.

  • 12.3. Place broken glassware inside a separate bag and notify the cleaning staff of this so to dispose of it safely.

13. PROBLEMS / COMPLAINTS. Any problems/complaints with anything at all inside the house and/or the services available in the house must be reported to the house manager immediately once a problem is identified to allow us the opportunity investigate and to fix the problem. The house manager will attend the property to evaluate the situation, and should remediation be required we will notify guests the approximate time our team will come to fix the problem. It is important guests are aware that access to the house by our team cannot be denied or unreasonably delayed when problems arise. Guests understand and agree that claims for refunds or monetary compensation partial or in full will not be applicable/accepted for issues that were not reported in a timely manner or at all and failing to allow remediation by the owner or the house team.

  • 13a. Out of control circumstances. On rare occasions, electricity or water supply may be interrupted due to city’s maintenance or acts of nature (rain, thunder, etc.) this could also affect cell phone signal, internet, etc. Each instance is different and out of our control. Guests acknowledge these are not grounds for refund requests partial or in full.

14. SAFETY. The property is quite safe, however the best safety or security measures will not work, if they are not properly or at all utilised. Doors and windows must remain closed when guests are not at the property or at night-time while they sleep. Tampering with any safety equipment such as but not limited to cameras, smoke detectors, etc. is a major security violation. Guests will be liable for any consequences this may bring and removed from the property immediately.

15. RETALIATION. Guests will not retaliate against the host or try to discredit the property, the host or any of its property agents because of damages caused to the property or guests due to lack of compliance with all or any of the rules by one or more of the attending guests and/or for problems not reported immediately or ever. Untrue/unjust accusations will be followed through in a legal manner.

16. DAMAGE DEPOSIT. A USD $1000.00 refundable damage deposit is required on or before 15 days of arrival. Instructions for the payment of the security deposit will be provided.

  • 16a. Following a post departure inspection, the damage deposit will be returned in full assuming that there are no damages or losses within 48-72 hours after your departure. Charges for damages or loses will be deducted from the security deposit at the discretion of the owner. To ensure transparency of this process, a full check with photographic and/or video evidence is taken prior and after each guest’s arrival/departure. Kindly refer back to clauses 2a, 2c, 3a, 4d, 5, 7, 9 and 10.

VILLA ESCONDIDA's INTELLECTUAL PROPERTY RIGHTS.

Unless otherwise stated, Villa Escondida San Miguel de Allende and/or its licensors own the intellectual property rights for all material on the Villa Escondida SMA's website. All intellectual property rights are reserved.

You must not at any time:

  • Copy or republish material from Villa Escondida SMA

  • Sell, rent, or sub-license material from Villa Escondida SMA

  • Reproduce, duplicate or copy material from Villa Escondida SMA

  • Redistribute content from Villa Escondida SMA

Villa Escondiida SMA reserves the right to monitor all Comments and remove any Comments that can be considered inappropriate, offensive, defamatory or causes breach of these Terms and Conditions in any other platforms.

You warrant and represent that:

  • You agree that Villa Escondida SMA's agents have the right to use your feedback in the form of reviews and photos or videos shared by you with the owner and/or management members of Villa Escondida SMA, to be used for their own marketing purposes in their social media platforms, website etc. Unless you indicate differently you will be credited with such reviews images and videos using only your first name and place of residence (city)

  • You hereby grant Villa Escondidia San Miguel de Allende a non-exclusive license to use, reproduce, edit, reproduce and edit any of your Reviews/Feedback, Images or Videos in any and all forms, formats, or media for the purposes above mentioned.
